Unless otherwise agreed to in writing, upon approved credit, standard terms of payment shall be 30 Days Net. A 1-1/2% monthly service charge may be added on invoices not paid when due. Returned checks are subject to $20.00 charge. If Buyer fails to fulfill these terms or if Seller at any time has any doubt as to Buyer's financial responsibility, Seller may demand immediate full payment and decline to make further deliveries. Buyer/applicant agrees to pay any collection cost incurred to collect delinquent amounts, including attorney's fees. Solvency is asserted each time a purchase order is placed.
Customer authorizes Seller, its affiliates or representatives, to send e-mails or faxes, of any kind, including but not limited to correspondence, promotional and advertising material, to Buyer or its affiliates.
Standard delivery is approximately 3-5 working days from date of shipment. Liftgate can be provided for an additional charge. Please add liftgate service as a separate line item on your purchase order. Please contact the freight carrier if you have special delivery hours. We do not schedule deliveries nor honor delivery schedules if included on your purchase order.
Shipping terms: FOB Origin, pre-pay and add. Shipping is prepaid and added to the invoice as a separate line item. Shipping and handling charges are not included in the selling price of our merchandise. Shipping and handling charges are for curbside delivery. Under no circumstances will we provide copies of our freight bills to customers.

Damaged Shipments: It is extremely important to inspect and note any damage that might be suspect. Holes, dents, tears, etc. should be noted on the form the driver gives you to sign accepting delivery. Failure to do so makes it extremely difficult to make a claim. If there is shipping damage and you have noted it on the delivery form; you can email us at csr@grizzly.com, call our customer service department at (800) 523-4777 or fax us at (800) 438-5901. We will take care of all the necessary arrangements to have the problem resolved.
Returns: Should you decide to return an item(s) for any reason, be it refund, exchange or warranty, please contact our customer service department at (570) 546-9663. They will take you step by step through the return process. Returns for refund or exchange must be within 30 days of purchase. Original shipping and handling charges are not refundable. All returns must be in original packaging, unused and in resalable condition. All returns are subject to a 10% restocking fee if returned for any reason other than damage or defect and merchandise must be shipped to us prepaid. All returns must have a return number on the outside of the package. Our warehouses can not accept C.O.D’s or items without a return number.
Backorders: If not specified, out of stock items will automatically be placed on backorder and shipped immediately when made available.
Confirmation: We DO NOT provide confirmation for the receipt of purchase orders. HOWEVER, if you provide an email address we will send confirmation when order has been entered and again when merchandise ships.
Purchase Order Policy: Schools and Government Agencies
Grizzly Industrial, Inc. requires all public and private schools and government agencies to submit an authorized, tangible Purchase Order before their order will be processed. Phone orders will not be accepted. Authorized Purchase Orders may be faxed to (800) 225-0021 or mailed to:

If you are a business or entity other than a school or government agency, we will strictly adhere to the purchase order policy that you selected on the credit application.
Please note: If you do not require authorized Purchase Orders and/or if you permit buyers to place phone orders, please be advised that your company/agency will be responsible for orders that were called in and taken from your buyer(s) in good faith.
Sales Tax: Sales tax is collected in the states of Missouri, Pennsylvania, and Washington unless we have a valid tax-exempt certificate on file.
Material Data Sheets: Material Safety Data Sheets (MSDS) for OSHA defined hazardous substances are available by request. Please include your request for MSDS on your PO. The information and recommendations contained on the MSDS supplied by the manufacturer is considered to be accurate and reliable. Grizzly Industrial, Inc., however, makes no warranty with respect to the accuracy or reliability of the information or the suitability of the recommendations. Grizzly Industrial, Inc. disclaims any and all liability to any user thereof.
Indemnity: The buyer shall defend and indemnify Seller from and against any and all loss of or damage to the merchandise, usual wear and tear excepted; any claim, cause of action, damages, liability, cost or expenses (including attorney's fees) which may arise or be incurred in any manner in favor of any person relating to the merchandise or any part of the merchandise, including by way of example but not of limitation, claims arising out of or incident to the construction, purchase, delivery, installation, ownership, leasing, sale, or return of the merchandise or as a result of its use, maintenance, repair, operation or condition thereof, whether or not any claimed defects in such merchandise or latent or are discoverable; and any claim, cause of action, cost, or expense arising for alleged patent infringement of, for, or as a result of claims for alleged strict liability in tort. The obligations of Buyer herein contained shall survive the expiration of the Agreement as to any loss, damages, claims, causes of action liabilities, costs, or expenses.
Limited Warranty: Grizzly warrants every product it sells for a period of 1 year to the original purchaser from the date of purchase. This warranty does not apply to defects due directly or indirectly to misuse, abuse, negligence, accidents, repairs, improper wiring, alterations, lack of maintenance or consumable parts. This is Grizzly’s sole written warranty and any and all warranties that may be implied by law, including any merchantability or fitness, for any particular purpose are hereby limited to the duration of this written warranty. We do not warrant or represent that our merchandise complies with the provisions of any laws, acts or electrical codes. We do not reimburse for third party repairs. In no event shall Grizzly’s liability under this warranty exceed the purchase price paid for the product and any legal actions brought against Grizzly shall be tried in the State of Washington, County of Whatcom. We shall in no event be liable for death, injuries to persons or property or for incidental, contingent, special or consequential damages arising from the use of our products.
Please note: Merchandise covered by a manufacturer’s warranty must be sent directly to the manufacturer for repair or replacement.
LIMITATION OF LIABILITY IN NO EVENT SHALL SELLER BE LIABLE FOR LOSS OF PROFITS, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS AGREEMENT OR OBLIGATIONS UNDER THIS AGREEMENT, NOR SHALL SELLER BE LIABLE FOR ANY DAMAGES CAUSED BY DELAY IN DELIVERY, INSTALLATION, OR FURNISHING OF THE MERCHANDISE OR SERVICES BY ANY MANUFACTURER OF THE MERCHANDISE OR OTHERWISE.
